Michelle Troconis Files Motion for Rectification in Appeal Over Missing Exculpatory Evidence

On April 28, Michelle Troconis’s appellate attorney filed a Motion for Rectification regarding key missing materials in her appeal.

Earlier this month, on April 7, attorney Pamela Nagy requested access to Giglio material — evidence that, by law, must be disclosed if it could be favorable to the defense. The State responded that the Giglio submission is missing. Despite efforts by court clerks to locate it, they have not been able to find it to this day.


Although the specific details of the Giglio material are not known, it is legally regarded as potentially exculpatory, indicating that it might assist in proving Michelle's innocence or lessen her culpability. The loss of this evidence raises significant concerns regarding the fairness and integrity of the proceedings. Judge Randolph examined the submission and decided that the information did not qualify as Giglio material, but he ordered it to be permanently sealed. Consequently, the defense was not allowed to review the information and was unable to raise any objections.


This is more than a clerical error — it’s a critical issue that could impact the outcome of the appeal. The defense has formally asked the court to acknowledge and address this failure through the motion for rectification.
