STAMFORD, Conn. (WTNH) — An attorney for Michelle Troconis has filed the paperwork for an appeal to overturn her conviction. Last year, the one-time girlfriend of Fotis Dulos was convicted on charges related to the presumed death and disappearance of Jennifer Farber Dulos.
The 1,000-page document filed with the court outlines the legal argument for overturning Michelle Troconis’ conviction on conspiracy to commit murder, tampering with evidence, and conspiracy to tamper with evidence, among other charges.
The appeal contends prosecutors had no direct evidence connecting Troconis to Farber’s death, so they tried to convict her by association and portraying her as a liar.
The document goes on to state that prosecutors “presented an immense amount of evidence focused almost entirely on Dulos’ role in the disappearance, but it failed to prove that Troconis knew of Dulos’ activities.”
Her lawyer argues Troconis should receive a new trial for several reasons: The state failed to prove the elements of all the crimes beyond a reasonable doubt; Investigators unreasonably seized her home for four days and then came back for another search without a new warrant; The court allowed statements from Troconis that she says were coerced by police. The list goes on.
Troconis is also arguing that she should be released from prison pending the appeal.
