On July 9, 2025 — one day before the State’s deadline to file its return in Michelle Troconis’ habeas corpus case — the state instead filed a motion for nonsuit, attempting to have the case thrown out by claiming her legal team failed to follow the judge’s instructions.

On August 8, 2025, Judge Carl J. Schuman of the Connecticut Superior Court denied that motion, finding that Michelle had complied with the court’s prior order. This decision allows her wrongful conviction challenge to move forward to trial.

“As a family, we are relieved that Michelle’s fight for justice can continue,” the Troconis family said in a statement. “This ruling means her case will be heard in court.”
