Michelle Troconis’s defense team has filed a formal request under Conn. Practice Book § 66-5 to rectify the appellate record. Why? Because the Herman report—a sealed custody evaluation by Dr. Herman—has gone missing from the trial court file.

The report was reviewed in camera by Judge Blawie, distributed to both the prosecution and defense, and was supposed to remain sealed in the clerk’s office. But now, as the case moves to appeal, court clerks are unable to locate it.

Troconis is asking to submit a new copy, have it reviewed by both parties, and officially mark it as a sealed court exhibit so the Appellate Court can examine it. Notably, the prosecution does not oppose this request.

A hearing on the issue has been scheduled for August 4th, 2025. The Herman report has been characterized in court as central to the defense’s case.
